By creating an account and utilizing the website and services for Salesing, you hereby agree to this Salesing Vendor Policy. You acknowledge and agree Salesing.com is a private site owned and operated by Salesing LLC. If you are utilizing a Vendor account at Salesing.com on behalf of a business, you represent and warrant that you have the authority to bind the business to the Terms of Use and the Vendor policy outlined here. If you are utilizing a Vendor account at Salesing.com as an individual, you are personally bound by the Terms of Use and this Vendor Policy. If you do not agree to the Terms of Use, you are not authorized to utilize a vendor account at Salesing.com. We may modify the Terms of Use and Vendor Policy at any time in our sole discretion. You are responsible for periodically reviewing these Terms of Use and Vendor Policy, and your continued usage of Salesing.com implies your acceptance of any modifications to these terms.
At no time are Vendors allowed to promote the sale of the following on Salesing.com
- offers, solicitation, or facilitation of prostitution and/or sex trafficking
- exploitation or endangerment of minors; child pornography
- prescription drugs, medical devices; controlled substances and related items
- adulterated food
- endangered species
- false, misleading, deceptive, or fraudulent content; bait and switch; keyword spam
- offensive, obscene, defamatory, threatening, or malicious postings or email
- anyone’s personal, identifying, confidential or proprietary information
- food stamps, WIC vouchers, SNAP or WIC goods, governmental assistance
- stolen property, property with serial number removed/altered, burglary tools, etc
- ID cards, licenses, police insignia, government documents, birth certificates, etc
- US military items not demilitarized in accord with Defense Department policy
- counterfeit, replica, or pirated items; tickets or gift cards that restrict transfer
- lottery or raffle tickets, sweepstakes entries, slot machines, gambling items
- spam; miscategorized, over-posted, cross-posted, or nonlocal content
- postings or email the primary purpose of which is to drive traffic to a website
- postings or email offering, promoting, or linking to unsolicited products or services
- affiliate marketing; network, or multi-level marketing; pyramid schemes
- any good, service, or content that violates the law or legal rights of others, including but not limited to intellectual property rights and privacy
DTPA Compliance for Products Marked “Made in USA”
Salesing.com offers search filters that specifically enable users to seek out products that are made in the United States, which are specifically labeled “Made in the USA” or “Made in America.” Vendors who label their products as such must ensure full compliance with the Texas Deceptive Trade Practices Act (DTPA), as further described in Texas Business and Commerce Code §17.46 with respect to the appropriate labeling and marketing of these products so as to not misrepresent the products’ origins. This implies that the product should be substantially made, manufactured, or assembled within the United States. By listing products under the “Made in the USA” or “Made in America” categories, vendors agree to hold Salesing LLC, as well as its employees, agents, representatives, and assigns harmless against any claims, losses, or legal actions arising from false or misleading labels. Failure to adhere to these requirements may subject the vendor to account review, potential termination, and possible legal repercussions as mandated by the DTPA.
Vendor Standards
Your business represents you and your business to the Salesing community. It is important that you, your items, and your shop are honestly and accurately represented.
By selling on Salesing, you agree that you will:
- Provide honest, accurate information to Salesing and in your About section
- Honor your shipping and processing times
- Ensure your content, such as any text, photos or videos to represent yourself, your business, or your listings, abide by Salesing policies
- Accurately represent your items in listings and listing photos
- Respect the intellectual property of others
- Not engage in fee avoidance (any action by a seller to avoid paying a fee)
- Not create duplicate shops or take any other action (such as manipulating clicks, carts or sales) for the purpose of shilling, manipulating search or circumventing Salesing’s policies.
- Not coordinate pricing with other sellers
- Respond to messages in a timely manner
- Honot the commitments you make in your business policies
- Resolve disagreements or order issues directly with the buyer
- Notify the buyer and cancel the order if you are unable to complete an order
By listing a product for sale on Salesing you understand and agree that you are responsible for complying with all applicable laws and regulations for the products you list for sale, including any required labels and warnings. Salesing assumes no responsibility for the accuracy, labeling, or content of your listings.
Communication Standards
Vendors may not participate in the following activities:
- Sending unsolicited advertising or promotions, requests for donations, or spam
- Harassing or abusing another member or user
- Contacting someone after they have explicitly asked you not to
- Interfering with a transaction or the business of another member
- Exchanging personal contact, financial or other information for the purposes of evading the checkout process on Salesing, including phone number, address, email, social media handles, external URLs, instructions for money transfer, etc.
Material Breach
A material breach of this agreement is defined and any substantiated claims or observed activity that suggests a vendor has done ANY of the following:
- Solicitation of Sex/Prostitution
- Promoting Human Trafficking
- Selling or Trafficking of Illegal Drugs
- Promoting or Selling Pornography
If a Vendor is found to have committed a Material Breach of this agreement, their account will be terminated, and their content will be removed from Salesing.com. If appropriate, the offending Vendor will be reported to law enforcement.
Complaint Mechanism
Any user or Vendor who uses Salesing.com can submit complaints about the service or other users and vendors by sending an email to [email protected]. The complaint must be detailed, specifying the nature of the grievance and any supporting evidence if available.
If a complaint about a vendor is substantiated, the vendor will be afforded an opportunity to correct the issue. If multiple complaints are issued against a vendor and the vendor chooses not to correct the issues, they risk having their account terminated. Decisions will be made on a case-by-case basis. Termination decisions are final and will be communicated to the vendor in writing.
Account Termination
If an account is terminated, all content and account information provided by the vendor will be removed from Salesing.com and any remaining balances on their accounts will be refunded. Any vendor who had an account terminated will NOT be eligible to set up a new account and may be reported to law enforcement, if applicable. Attempts to violate this clause may result in legal action.
Intellectual Property Rights
Vendors shall ensure that all materials they post or list on Salesing.com —such as product descriptions, logos, images, videos, digital downloads, software, and other forms of content—complies with all applicable intellectual property laws and does not infringe upon any third-party intellectual property rights such as copyright, trademark, or patent. Violation of this term will result in immediate removal of the content and potential legal consequences.
Compliance with Export Laws
Vendors are responsible for compliance with all applicable export and import laws, regulations, and orders of the United States or any foreign governmental agency. Vendors must obtain all necessary export and import licenses, permits, and clearances, and are responsible for payment of all customs duties, taxes, and fees associated with exportation or importation. Vendors must also maintain complete and accurate records of all export and import documentation and activities and shall make these available for review by Salesing LLC or any applicable governmental agencies upon request. Non-compliance with applicable export and import laws is considered a material breach of this Vendor Policy. Vendors found to be in violation may have their accounts temporarily suspended or permanently terminated, and may also be reported to relevant governmental agencies.
Dispute Resolution
Any disputes arising between Salesing LLC and a vendor shall first attempt to be resolved through mutual discussion. If the dispute is not resolved through mutual discussion, Salesing LLC and the vendor agree that the dispute shall be resolved by binding arbitration. Such binding arbitration shall be conducted before one (1) arbitrator in Bexar County, San Antonio, Texas, in accordance with the rules of the American Arbitration Association (“AAA”) then in effect. The arbitrator shall not have the authority to add to, detract from, or modify any provision of this Vendor Policy. The decision of the arbitrator shall be final and binding on the parties, and judgment thereon may be entered in a court of competent jurisdiction. All expenses of arbitration, including reasonable attorneys’ fees, shall be borne by the losing party to the arbitration.
Indemnification
Vendors will hold Salesing LLC and its employees, members, agents, representatives, assigns, and subsidiaries harmless from and indemnify and defend them against all damages, losses, injuries, liabilities, penalties, costs (including attorneys’ fees), claims, demands, litigation, and judgments (a) arising from or incurred in connection with the vendor’s violation of any terms outlined in this Vendor Policy, the Terms of Use, or any applicable laws, regulations, and ordinances, including but not limited to, violations related to intellectual property rights, export and import laws, and data protection, or (b) caused by any negligent or willful misconduct by the vendor, their employees, subcontractors, or agents, in the performance of services, or in the listing, selling, or provision of any goods, services, or digital content through Salesing.com
Severability
If any provision of this Vendor Policy is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Vendor Policy shall otherwise remain in full force and effect and enforceable.
